Terms and Conditions

Interpretation

In these Terms and Conditions (Terms) the following words and phrases shall have the following meanings: “the Buyer” means the person or business who purchases goods from the Company; “the Company” means [ATOG Direct]; “Contract” is the contract between the Company and the Buyer which shall be deemed to incorporate these Terms; “Goods” means any goods agreed in the Contract to be supplied by the Company to the Buyer; “Place of Delivery” means the place to which the Goods are to be delivered. In these Terms, reference to any statute or statutory provision shall be construed as a reference to such statute or statutory provision as amended, modified, re-enacted, or replaced from time to time.

The Contract

The Contract shall be on these Terms and will form part of the Contract between the Buyer and the Company.

The Company does not disclose Buyer’s information to third parties other than when order details are processed as part of the order fulfilment. The Company may send you information which we feel may benefit you from time to time, either by email or by post.

Delivery

Any dates specified by the Company for delivery of the Goods are intended to be an estimate only and the Company shall not be liable for any direct or consequential economic loss or loss of profits arising directly or indirectly from any delay in the delivery of the goods. If you need a guaranteed date for the goods, please contact us directly to ensure this is possible.

N.B. Please remember it is possible that goods can arrive damaged, so do not pay an installer until the goods have arrived.

We do not deliver goods to areas outside of the United Kingdom or Ireland. Goods should be checked upon receipt and in any event damages and shortages must be reported to the Company within 48 hours of receipt. If goods purchased are taken overseas and are found to be not suitable, we will ship any replacements required to the original delivery address given and will not be liable for any costs incurred.

For bespoke Shower Enclosures and bespoke Balustrades: please note that deliveries to zone 5 postcodes will be subject to a delivery surcharge. The surcharge will be dependent on the delivery address location and product dimensions. Delivery quotations are provided after the product quotation is configured.

Ownership of Goods

Risk in the Goods shall pass to the Buyer on delivery. Ownership in the Goods shall not pass to the Buyer until the Company has received in full cleared funds of all sums due to the Company.

Payment

Goods will not be delivered until payment is received in full. As soon as payment is received, written confirmation of the transaction will be sent within 24 hours of receipt.

Warranties

The Company warrants that the Goods are of satisfactory quality. If the Buyer wishes to make a claim under this warranty, the Buyer shall give written notice to the Company within 30 days of the discovery of the defect and give the Company a reasonable opportunity to inspect the Goods in question. The Buyer may be requested to send photographs via email as means of verification.

The Company shall not be liable for any breach of warranty if the Buyer makes any further use of the Goods after giving such notice or alters or repairs the Goods without the agreement of the Company. The Company’s liability under the warranty shall be limited to repairing or replacing the Goods in question or refunding the price of such Goods. The Buyer must allow the Company reasonable opportunity to resolve the concern.

Returns & Refunds

All our parts are fully returnable and refundable if they are returned to the Company in the original packaging and are unused. To make a return, please email the Company with your order number and state the items which you wish to return. The goods will need to be sent to the Company via a tracked delivery service. The return is at your cost. Upon receipt of the goods, they will be checked and the refund processed. Please be aware there is a 5% restocking fee on all returns. Please note if the item is not in its original packaging, there will be a 30% deduction from the refund.

The glass we supply is made to order and as such is exempt from cooling off periods and distance selling regulations in respect of returning the goods. Cancellations will not be accepted once you approve your drawing. If you wish to cancel after payment has been made and before accepting your drawings, there will be a £40 + VAT charge.

Prior to Installation

Always ensure that goods are thoroughly checked prior to installation to ensure they are free from visible damage, blemishes, and are the correct size, etc. Items that are installed are deemed to have been accepted in terms of quality and size and cannot be replaced in these circumstances.

The Company is not liable for any delays or costs incurred due to any delay in receipt of goods, the incorrect content, or condition. Every effort will be made to ensure that your goods reach you on a timely basis, that they are correct, and are fit for installation. We strongly suggest that the installer is not arranged until you are confident that they can proceed furnished with the products they require to complete the installation efficiently.

It is recommended that installation of products be completed by a competent person. Please remember to take extra care when installing glass products. This type of product needs specialist handling during installation to ensure that the glass is not stressed during the installation process.

Design & Installation Terms

Our design experts are here to support you throughout your bespoke journey. However, please note that as we offer a supply-only service, all designs are based solely on the measurements you provide. Therefore, we cannot be held responsible for any issues arising from inaccurate measurements or errors made during installation.

Installation is straightforward, and we will provide guidance, discuss the process with you, and supply clear instructions. While we do our best to support you, mistakes can occasionally happen. Should an issue arise during installation, we will do our best to help rectify it, but we cannot accept responsibility for any errors made during fitting.

Free Delivery Promotion

The free delivery promotion applies to shower enclosures consisting of a minimum of one fixed panel and one door panel. This offer is subject to available delivery slots.
